Lawyers win largest toxic tort, 9th largest motor vehicle verdicts of the year

DALLAS – Attorneys from Dallas-based Simon Greenstone Panatier, PC, a nationally recognized trial law firm, won two of the largest verdicts in Texas last year, according to the publishers of VerdictSearch. The firm’s wins will be highlighted in Top Texas Verdicts & Settlements of 2014, which will be inserted in the May 25 edition of Texas Lawyer.

The firm scored the state’s largest toxic tort verdict in Vicki Lynn Rogers, et al. v. The Goodyear Tire & Rubber Company. Dallas County jurors awarded a significant sum to the family of a tire builder who died after exposure to asbestos fibers at a Goodyear Tire & Rubber Co. (NASDAQ:GT) plant in Tyler, Texas. The verdict was No. 22 overall in Texas last year.

The family of Carl Rogers was represented by named shareholder Christopher J. Panatier and associate Darren McDowell. Mr. Rogers worked at the Goodyear plant for 30 years before being diagnosed with mesothelioma, a deadly cancer caused by exposure to asbestos. He died in September 2009, approximately one year after being diagnosed. Jurors found Goodyear grossly negligent for allowing Mr. Rogers’ continued exposure to asbestos.

In Bobbie Bush v. Greenwood Motor Lines Inc., et al., another Dallas County jury awarded a substantial judgment to Bobbie Bush for her injuries from a collision with a double tractor-trailer owned by Greenwood Motor Lines. The award was the state’s ninth largest motor vehicle verdict and ranked No. 44 overall.

Simon Greenstone associate Ron McCallum, who heads the firm’s Catastrophic Injury practice, worked as co-lead counsel. Case evidence showed that Ms. Bush was driving under the posted speed limit when she was rear-ended by the truck, which was traveling at least 10 mph over the posted limit.

Ms. Bush required years of physical therapy and cervical surgery. She still suffers from chronic headaches, memory loss and depression, and has been unable to work since the 2011 collision. Jurors found both the driver and the corporation that employed him negligent and grossly negligent.
